PERSONAL INFORMATION

WHAT INFORMATION DO WE COLLECT?

Wunder Fleet GmbH only collects personal information such as first and last name, address, phone number and email address when you give them voluntarily yourself.

PASSING ON PERSONAL INFORMATION

We will only send marketing material to you with your permission. If you do not consent to receive this type of material, we will not send it to you.

Certain companies, namely Business Associates, employ Wunder Fleet GmbH to provide software services for their vehicle sharing business. These companies will have access to your personal information in order to perform their work and they may not use it for other purposes.

Wunder Fleet GmbH neither sells, transfers or discloses your personal information to a third party. With your permission, however, we, or our business associates, will now and then send marketing material on behalf of one of our business associates concerning their products or services, which might have your interest.

Wunder Fleet GmbH reserves the right to use and disclose personal information if it is necessary to comply with legislation, regulations or legal requests, to ensure the inviolability of this website, to comply with your requests, or to assist in any legal investigations or court cases about the security of life and property.

ACCESS

You have the possibility of gaining full access to the personal information you give to us through the Internet. If you, at any time, want to change the personal information we have registered about you, or if you want to change the access we have to contact you, you can always contact us and notify us about it.

COOKIES

This website uses cookies. A cookie is a small text file saved on your computer which contains information making it possible to follow your movements on the website. Cookies are used for you as a visitor to gain access to various functions on the website.

TERMS

1. Definitions

1.1 Terms – Refers to the present lease terms.

1.2 The User – Refers to the natural person who uses the City Vehicles offered on the mobile application.

1.3 Ride Fleet – Wunder Fleet GmbH – VAT No.: DE 815 471 165

1.4 Business Associates - Refers to mobility operators that use Wunder Fleet GmbH software services for their own vehicle sharing business. Each Business Associate is responsible for the operations in a different Zone. A list of our Business Associates can be found on this link https://www.ride-fleet.com/business-associates

1.5 City Vehicle(s) – Refers to any vehicle (kick-scooter, moped, bike or car) provided by Ride Fleet’s Business Associates to the User according to the Terms.

1.6 Rental period – Refers to the period from when the User unlocks the City Vehicle and until the User terminates the lease through the mobile app.

1.7 The Zone – Refers to the area defined by Ride Fleet in which it is possible to start and end the Rental period and appearing from the mobile app and on the Ride Fleet website

1.8 The Price list – Refers to the price list in force at any time for using and renting the City Vehicle. A link to the price list can be found on this link: https://www.ride-fleet.com/pricing.

2. In general

2.1 Any deviation from these Terms must be made in writing to be valid.

2.2 Ride Fleet reserves the right to change the Terms from time to time. If Ride Fleet makes substantial changes in the Terms to the disadvantage of the User, the User will be asked to accept the changed Terms before the beginning of a new Rental period.

2.3 Ride Fleet reserves the right to immediately block the User’s access to the City Vehicles in case of a violation of these Terms or if the merits of the case call for it. Furthermore, the User must indemnify Ride Fleet for any loss suffered by Ride Fleet due to the User’s violation of the Terms or the legislation in general, and the User is liable for any administrative fee according to the Price list.

2.4 Ride Fleet reserves the right to register information on the user in case their Ride Fleet profile is blocked. The user can hereby be refused to open a new Ride Fleet profile. Ride Fleet can deny approval of a user if the person is registered on a so-called “Blocked List”.

 

3. Customer relationship

3.1 When registering, the User acknowledges having concluded a binding electronic agreement with Ride Fleet and its Business Associates, and that the User is thus bound by the Terms, and together with the Price list, they form the entire basis for the agreement between Ride Fleet, its Business Associates and the User. In addition, by agreeing to these Terms, the User warrants and represents that they are at least 18 years of age, or an age at which the User is permitted to use the City Vehicles in the relevant jurisdiction they intend to use such Vehicles.

3.2 The User’s login to Ride Fleet is personal and may only be used by the User himself/herself. In case of unauthorized use of the User’s login, the User is liable for a fee according to the Price list and any consequential costs. The user and driver are both liable for all consequential costs including damage costs regardless of the insurance.

The User may only use the User’s own information when creating and later changing his/her login/profile. Thus, the User is not allowed to use other people’s driver’s license information, credit card information, or contact information.

3.3 When registering, the User must be of legal age to conduct the City Vehicles in their region.

  1. Must use a valid credit card with an available amount sufficient to cover the excess for damages.

3.4 When registering, the User gives Ride Fleet and its Business Associates permission to verify the personal information provided by the User. If there are credit notifications or discrepancies between the information provided by the User and the official information, Ride Fleet and its Business Associates reserve the right to reject the customer’s registration. If such a credit notification or discrepancy arises during the contractual relationship, it is considered a violation of these Terms.

3.5 The User must ensure that all information about the User is up-to-date at any time. The User’s information can be updated through the Ride Fleet website, mobile app or customer service at any time.

3.6 The User always has the right to cancel his/her registration at Ride Fleet. When canceling, the User is still liable for any due payment, and likewise, the User can demand to have an outstanding amount reimbursed to his/her credit card.

3.7 If the User does not use the City Vehicles for 90 consecutive days, Ride Fleet and its Business Associates reserves the right to deactivate the User, and then he/she has to register again.

 

4. The City Vehicle

4.1 When starting a trip, the User confirms that the City Vehicle is received in good and legal order having checked the brakes,, and lights before starting to drive. Any complaint about the condition of the City Vehicle must be advanced to the Business Associate responsible for the Zone where the rent is being made before driving the car.

4.2 The User confirms having been notified that all City Vehicles are equipped with satellite tracking.

4.3 Stickers or other ornamentation must not be removed from the City Vehicle. If these or parts of these are removed, the User is charged for the Business Associate's costs to replace them.

4.4 The City Vehicle must not be used:

  1. For the transport of passengers or goods for money, neither directly or indirectly.

  2. In contravention of local laws applicable to the type City Vehicle in use. 

4.6 It is prohibited to:

  1. Use the City Vehicle in  a manner that is not consistent with the intended use of such City Vehicles, 

  2. Smoke in the City Vehicle or allow others to smoke in the City Vehicle.

  3. Deactivate the passenger airbag.

  4. Make repairs or changes to the City Vehicle without prior approval from Ride Fleet and its Business Associates.

  5. Transfer the right to drive the City Vehicle to another person than the registered User. Violation of this will result in loss of insurance coverage and a fee of EUR 1000 plus all costs resulting from the driving.

  6. Leaving the City Vehicle outside of the business operation area. If the City Vehicle is left outside of the delimited polygon in the map, the City Vehicle will be towed back to its rightful Zone for the User’s expenses.

  7. To let the City Vehicle reach 0% power outside of the business operation area. If the City Vehicle has no power left outside of the delimited polygon in the map, the User will be charged a towing fee.

4.7 Ride Fleet and its Business Associates reserves the right to take possession of the City Vehicle at any time and without claim for the account of the User, if the vehicle is used in violation of the Terms. In this case, the User is not entitled to a replacement vehicle or financial compensation, and any transport is for the account of the User.

4.8 If the police or any other public authority determines that the City Vehicle has been used for illegal or inappropriate purposes during the lease, they have the right to immediately seize the car without the User being entitled to a replacement vehicle or financial compensation. The User is liable for any transport in this connection.

4.9 Ride Fleet and its Business Associates cannot be held liable for damages for loss or damage as a result of the User’s use of the City Vehicle, including damage to third-party goods, unless Ride Fleet or its Business Associates has acted with particular negligence.

4.10 In no case can Ride Fleet and its Business Associates be made liable for damages for indirect loss, including loss as a result of the User’s delay, if the City Vehicle is not available or breaks down while in the possession of the User.

4.12 If Ride Fleet or its Business Associates requests it, the User must notify Ride Fleet about where the User parked the City Vehicle when ending the Rental period.

4.13 Ride Fleet and its Business Associates are not responsible for private objects being damaged, lost, or forgotten during or after the lease.

5. The Rental period

5.1 When booking Your City Vehicle in the app, the City Vehicle is reserved for the minutes that the User chooses to reserve.  The initial minutes are free for each trip. After a certain time you will be charged per minute you hold the reservation. The amount of free minutes as well as the price for reservation can be found on the Price list.

5.2 The Rental period starts when the User unlocks the car with the mobile app. The User’s responsibility for the City Vehicle commences at the same time.

5.3 Before using the City Vehicle, the User must also check for damages to the City Vehicle not already registered. If the City Vehicle is in such a damaged condition that the User does not want to drive it, the User can contact and notify Ride Fleet and its Business Associates about this after which any time used for inspection will be credited.

  1. The User must immediately report damages to or errors on the City Vehicle not already indicated to Ride Fleet through the app.

  2. If Ride Fleet or its Business Associates assesses that damages or errors must be investigated or repaired before the City Vehicle is used, Ride Fleet reserves the right to reject the User’s use of the City Vehicle.

5.5 During the Rental Period, the User must:

  1. Only drive the City Vehicle if the User is physically and mentally capable of driving the City Vehicle.

  2. Obey the local laws and regulation applicable to the use of the City Vehicle  from their Zone in every respect.

  3. Properly ensure the City Vehicle against theft by locking the City Vehicle as directed in the terms of use when parking  it.

  4. Treat the City Vehicle correctly and properly, as could be expected from an ordinary average person renting a car (also known as “the reasonable man”).

5.6 To end the lease of the City Vehicle, the City Vehicle must be parked inside the Zone or another area approved by Ride Fleet and its Business Associates, and the parking must also comply with the provisions in these Terms.

5.7 The Rental period for the City Vehicle is not ended until the User has ensured the above and when the User subsequently has ended the lease through the mobile app.

5.8 The User is responsible for ending the lease correctly. If the User has problems ending the lease of the City Vehicle, the User must immediately notify Ride Fleet and its Business Associates about it and stay with the City Vehicle until Ride Fleet or its Business Associates have stated what will happen next.

6. Liability

6.1 Ride Fleet is solely a provider of Software services and, therefore, is exempt from any liability pertaining to on-the-ground operations, vehicle utilization, accidents and damages to the City Vehicles, Users or others. To this end, the Business Associates are responsible for the City Vehicles and obtaining the necessary permits in order to operate in the respective territory in which they are located.

7. Settlement

7.1 The price for renting the City Vehicle is calculated from the duration or trip length of the Rental period (pr. started minute) according to the Price list in effect at the beginning of the Rental period. 

7.2 If the User has chosen settlement by the minute (pr. started minute), Ride Fleet and its Business Associates will charge the amount due for renting the City Vehicle on the User’s credit card when the User has ended the Rental period of the City Vehicle. From the next day, the User can see his/her usage in the app and on the website.

7.3 In some Zones the User can choose to buy a discount package with prepaid minutes. The price of the package is deducted in regarding the purchase and the prepaid minutes can hereby be used. They are valid from 6 to 12 months from the date of purchase cf. Pricelist. Driven minutes beside the included minutes in the packages will be priced at normal tax. Notice that the 14 days of cancellation rights are no longer possible when the user has started to use the minutes in the package.

7.4 The User’s price for renting one and the same City Vehicle within 24 hours can never exceed the maximum price per day given in the Pricelist. If the User at the end of the day is still driving the City Vehicle, the remaining minutes will be invoiced at ordinary minute rate, cf. the Pricelist.

7.5 The ”Invite a friend” service can only be used for its original purpose as described on the website. If the User does not act in compliance with the rules, all earned minutes will be canceled and the User’s account and associated, newly created accounts will be suspended.

7.6 The User is made aware that tax liability may arise in accordance with applicable tax rules if the User’s employer has paid for the bonus-giving trip and the earned minutes are used privately. This is to be compared with other special wage supplements that must be reported by the recipient to the tax authorities and this is irrelevant to Ride Fleet, as Ride Fleet does not acknowledge any liability for the User’s tax obligations. Reserving and renting the City Vehicle does not include a cancellation right.

7.7 After the end of the Rental period, the User is still committed to having sufficient coverage on his/her credit card to cover other costs in connection with the lease according to these Terms, including paying for damages, tickets, compensation, and other fees. If such claims to the User arise, Ride Fleet and its Business Associates will contact the customer with information about this before the amount due is charged from the User’s credit card.

7.8 If a charge is rejected by the User’s credit card issuer and it is due to the User’s own circumstances, Ride Fleet may charge additional remuneration from the User.

7.9 Ride Fleet and its Business Associates reserves the right to transfer claims against the User. Then the User can only pay in full satisfaction of the debt to the recipient of Ride Fleet’s claim against the User when the User is informed about the transfer.

 

8. Personal data

8.1 In connection with his/her registration, the User gives Ride Fleet and its Business Associates permission to send news and the like to the customer’s email address. The User has the right to, at any time, withdraw the permission by emailing to dpo@wundermobility.com.

8.2 Ride Fleet collects, stores and processes personal information about the User. Details of that information can be found in Ride Fleet’s privacy policy.

8.3 Certain companies may be employed by Ride Fleet and its Business Associates to perform various work in connection with the services provided by Ride Fleet and its Business Associates. These companies may have access to personal information if it is necessary for performing the work, but they can only use the personal information necessary for performing their work, and they may not use it for other purposes. The identities of the companies in question can be found in our privacy policy at ride-fleet.com.

8.4 Ride Fleet and its Business Associates reserve the right to use and disclose personal information if it is necessary to comply with legislative requirements, to comply with the User’s requests, or to assist in any legal investigations or cases about the security of life and property.

8.5 The User has the option of gaining full access to the personal information given to Ride Fleet by the User. If the User at any time wants to change or delete the personal information Ride Fleet has registered about the User, or if the User wants to change the access Ride Fleet has to contact the User, the User can always contact Ride Fleet or its Business Associates and notify them about it. The User may also have the personal information delivered to himself/herself or to a data controller chosen by the User. 9. Complaints

9.1 These Terms and any dispute between Ride Fleet, its Business Associates and the User will be construed in accordance with German case law and the proper forum in Hamburg.

9.2 If one or more of the provisions in the Terms are declared invalid, the remaining provisions are still valid.

Amendments

Ride Fleet reserves the right to modify these Terms and Conditions at any time, effective upon posting an updated version of these terms and conditions in the mobile application.
